If your initial CPP disability claim has been denied, don't give up. Many people go on to get benefits awarded during the appeals process.

There are several things you need to know about the CPP disability appeals process.

First, the CPP appeals process follows several levels of appeal. I have set out the various levels of appeal below. Keep in mind that once your claim is denied, you must file an application or notice of appeal, to the next level, within 90 days of receiving the denial letter. It is extremely important that you do not miss these deadlines as you could lose your right to benefits.

Second, when making an appeal it is important that you provide the decision-maker with new medical evidence or new legal arguments in support of your claim. Again, I cannot stress how important this is. Failure to do so can result in a dismissal of your claim. It is common for people to fail to get the proper medical evidence to support their claim or to fail to consider legal principles or case law that may affect their case. This is why it is highly advisable for you to consult a lawyer, experienced with CPP disability appeals, before moving on to the next level of appeal. The sooner you see a lawyer the better.
